Terms and Conditions

These terms govern your use of Formera, a digital planner provided by Maria Fethers, trading as Formera Official (referred to as "Formera", "we", "us", or "our"). By creating an account or using the planner, you agree to these terms.
1. Who you are contracting with
The service is operated by Maria Fethers, trading as Formera Official, an individual sole trader based in the United Kingdom. You can contact us at hello@formeraofficial.com.
2. Acceptance
By accessing or continuing to use Formera, you confirm you have read, understood, and accepted these terms. If you do not agree, please stop using the service. You must be at least 16 years old, or the age of digital consent in your country, to use Formera.
3. What Formera is
Formera is a calm daily planner with sections for focus, weekly review, vision, journal, and wellness. Two products are offered: a one-off Lifetime planner that stores data in your browser, and an optional Sync subscription that stores your planner data securely in the cloud so you can access it on any device where you sign in.
4. Acceptable use
You agree not to misuse Formera. In particular, you must not: use the service for any unlawful purpose; commit fraud or send spam; infringe anyone's intellectual property; attempt to interfere with the security or integrity of the service (including by uploading malware, probing, or scraping); or attempt to reverse engineer the service.
5. Account and data accuracy
You are responsible for keeping your account credentials confidential and for activity under your account. You agree to provide accurate information and keep it up to date.
6. Intellectual property
Formera and all related software, design, branding, and documentation remain the property of Maria Fethers. You receive a limited, non-exclusive, non-transferable right to use the planner for your personal use under the plan you have purchased. The content you create inside Formera (notes, entries, plans) remains yours.
7. Payment, billing, and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. You can manage or cancel your Sync subscription at any time via paddle.net or by contacting us.

8. Service level and warranties
We work hard to keep Formera available and reliable, but we do not guarantee that the service will be uninterrupted, error free, or always available. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, fail to pay, present a security or fraud risk, or repeatedly violate our policies. You may stop using Formera at any time. On termination, you can export your data for a reasonable period before it is deleted.
10. Liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to Formera is limited to the fees you paid us in the twelve months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded by law.
11. Changes to these terms
We may update these terms from time to time. If we make material changes, we will let you know via the site or email. Continued use after the changes take effect means you accept the new terms.
12. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
